Access to documents: Client Earth commences proceedings against Commission before the General Court

The questions in ClientEarth v Commission (T-255/20), a case pending before the General Court, have been officially published.

Client Earth seeks annulment of the ‘implied decision’ of the Commission in case GESTDEM No 2019/6819 refusing its request for access to documents.

It submits three grounds of claim in support of that request:

(i) that the Commission committed manifest errors of assessment and errors of law, resulting in misapplication of the protection of the decision-making process in Regulation 1049/2001, and that it failed to state reasons as required by Article 296 TFEU; (ii) it committed manifest errors of assessment and errors of law resulting in misapplication of the public interest test set out in that
