AG Bobek Opinion on the competence of supervisory authorities to monitor courts in their compliance with GDPR

Advocate General Bobek in his Opinion in Autoriteit Persoonsgegevens (C-245/20), considers that courts’ practice of the disclosure of procedural documents to a journalist for the purpose of better covering a public hearing is carried out by courts ‘acting in their judicial capacity’ and thus supervisory authorities are not competent to monitor such processing operations. 

The case originates in the complaint against the granting of access to the procedural documents related to the applicants’ case to a journalist, who has acquired mentioned documents on the basis of the principle of open justice under which the press in the Netherlands can access certain procedural documents in the cases scheduled before the court for that day in
