AG Campos Sánchez-Bordona: ​​general and indiscriminate retention of traffic and location data only allowed for serious threats to national security

Advocate General Campos Sánchez-Bordona delivered his Opinion today in three cases concerning the conditions for the general and indiscriminate of traffic and location data, advising the Court to rule that it is only permitted in the event of a serious threat to national security. The cases are SpaceNet and Telekom Deutschland (joined cases C-793/19 and C-794/19); Commissioner of the Garda Síochána and Others (C-140/20); and VD and SR (joined cases C-339/20 and C-397/20).

All the cases concern requests for a preliminary ruling that seek clarification on the conditions for the general and indiscriminate retention of data for the purposes of guaranteeing public order. The two first requests, referred to by the German Federal Adminis
