AG: General Court ruling on harassment of EU staff should be overturned
In today’s Opinion in case of HF v Parliament (C-570/18 P), Advocate General Øe proposes that the Court of Justice overturn the General Court’s judgment that rejected the applicant’s action against the European Parliament’s decision not to grant assistance to a member of staff alleging harassment in the workplace.
In his Opinion, the AG considers that the decision of the Parliament not to grant the right to be heard to the complainant in the course of the internal investigations, particularly the right to submit observations to the minutes of the witnesses’ statements, was a breach that could have led the authority to assess the case differently. As a result, the AG proposes that the Court quash the judgment of the General Court and rule on the merits of the case, for which he also proposes the annulment of the European Parliament’s decision.
