AG Pitruzzella advises Court of Justice to annul Council Decisions on the implementation of the EU’s Partnership Agreement with Armenia

Advocate General (AG) Pitruzzella delivered his Opinion in Commission v Council (Accord avec l’Arménie) (C-180/20) today, advising the Court of Justice to rule that the Council of the EU chose the wrong legal bases for the implementation of the Comprehensive and Enhanced Partnership Agreement (CEPA) with the Republic of Armenia.

The case is an action for annulment brough by the Commission against two Council Decisions regarding the position to be taken on behalf of the EU within the Partnership Council established by the CEPA as regards the adoption of the rules of procedure of the Partnership Council and those of the Partnership Committee, subcommittees and other bodies set up by the Partnership Council, and the establishment of
