AG Szpunar: Commission’s external powers not violated when EU cannot act in its own name

Advocate General Szpunar delivered his Opinion in Commission v Council (Organisation maritime internationale) (C-161/20), concerning an action for annulment brought by the Commission against a Council decision endorsing a submission made by Croatia, acting on behalf of the Council during its presidency, to the International Maritime Organization (IMO) concerning the introduction of life cycle guidelines to estimate well-to-tank greenhouse gas emissions of sustainable alternative fuels

The Commission challenged the decision claiming that only the EU could make the submission in view of its exclusive competence over the subject matter covered in the submission and that insofar as the submission was an act of external representation,
