Analysis: “AG Kokott’s Opinion in C-66/18 (Hungarian Law on Higher Education Institutions)” by Paul Dermine

Last week, Hungary came under the spotlight at the Court of Justice once again. After Advocate General Sanchez Bordona’s Opinion in case C-78/18 on the Hungarian law on the transparency of associations’ earlier in January (see my comment for EU Law Live here), the much awaited Opinion of Advocate General Kokott in Commission v Hungary, case C-66/18 on the 2017 amendments to the Hungarian law on higher education institutions came out on Thursday 5 March 2020. Although both cases focus on different legal issues, they are very much related in that they deal with reforms implemented by the Orban government and an overall strategy of keeping independent institutions (and potentially dissident voices) in check.
