Analysis: “Aggregating Sentences across the EU. A Step towards a more Integrated Area of Justice?” by Leandro Mancano

Introduction

In yesterday’s judgment AV (Jugement global) (C-221/19), the Court clarified important aspects concerning the possibility to issue an aggregate sentence in one Member State, even when one of the judgments was issued by the court of another EU State.

Background to the Case and Court’s ruling

AV was imposed a custodial sentence of five years and three months by judgment of the Regional Court of Lüneburg on 15 February 2017. Through application of Framework Decision (FD) 2008/909/JHA, the penalty was recognised by Poland.
