Analysis: “Dalli v Commission and the investigatory powers of OLAF” by Ana Bobić

The Court of Justice has rejected the appeal (C-615/19 P) brought by a former European Commissioner, John Dalli, who requested annulment of the decision of  the General Court (T-399/17). In both proceedings, Mr Dalli sought compensation based on the allegedly illegal conduct of OLAF and the Commission.

By way of a brief background, Mr Dalli was the European Commissioner with the health and consumer protection portfolio from 2010. In 2012,  the company Swedish Match brought allegations against him concerning his behaviour, and as a result, OLAF initiated an investigation.
