Analysis: “What would a reasonable journalist have done? Balancing insider dealing law and media freedom in Case C-302/20” by Emilia Korkea-aho

Last week, on 15 September 2021, Commission President Ursula von der Leyen held the annual State of the Union address. One of the themes that she raised concerned media freedom. Journalists have been facing an increasing number of attacks over the past years, including assassinations in the most tragic cases. Against this background, von der Leyen demanded that the EU, together with its Member States, protect those who promote transparency. She announced the adoption of a Recommendation to strengthen the safety of journalists and other media professionals. A European Media Freedom Act is expected in 2022, to safeguard the independence of media.
