CJEU to rule on the categorisation of honorary judges under employment Directives

Publication has been made in the Official Journal of the request for a preliminary ruling (C-834/19) lodged by the District Court of Vincenza, Italy (Tribunale di Vicenza) in the case AV v Minister for Justice and the Italian Republic. The reference revolves around the concepts of ‘part-time worker’ and of ‘fixed-term worker’ contained in Clause 2 of the Framework Agreements annexed to Directive 1997/81/EC and to Directive 1999/70/EC respectively.

Specifically, the referring jurisdiction asks the Court of Justice whether a national practice whereby honorary district court judges are excluded from both concepts constitute an obstacle to the effectiveness of the aforementioned Directives.
