ClientEarth challenges refusal to provide documents on deforestation and forest degradation

ClientEarth AISBL has lodged an action for annulment (ClientEarth v Commission, T-661/21) against the European Commission, in which it challenges its implied decision to refuse access to certain documents related to deforestation and forest degradation pursuant to Regulations 1049/2001 and 1367/2006.

In support of its action, ClientEarth claims that the Commission implicitly refused access to the documents within the meaning of Article 8(3) of Regulation 1049/2001 as a result of the failure to address it with an express decision within the time-limits for processing confirmatory applications.
