Commission opens in-depth investigation into alleged State aid received by Fred Olsen from Canary Islands port authority

The European Commission has announced it has opened an in-depth investigation to reassess whether Spanish shipping company Fred Olsen SA received unlawful State aid from the Canary Islands port authority. 

The decision follows a General Court ruling in Naviera Armas SA v Commission (T‑108/16), by which it partially annulled a Commission decision of December 2015 concluding that the conditions of use of the publicly financed port infrastructure granted to Fred Olsen did not constitute State aid. The General Court annulled the decision on the basis that the Commission had come to its conclusion without opening a formal investigation procedure under Article 108(2) TFEU.
