Condor Flugdienst brings action against Commission over compatibility of Lufthansa’s aid

Germany-based Condor Flugdienst GmbH has brought an action by which it seeks the annulment of a State aid decision made by the European Commission (T-80/21).

Condor Flugdienst requests that the General Court rule that the European Commission has not complied with Article 108(2) TFEU, concerning the obligation to commence a formal investigation procedure as regards the compatibility of aid granted by Member States with the internal market. 

Condor Flugdienst alleges that the Commission has failed to adequately assess the compatibility of the aid received by Deutsche Lufthansa AG with the internal market, in light of Article 107(3)(b) TFEU. In June 2020, the Commission approved a six billion euro-plan to recapitalise Deutsche
