Council’s decision to extend freezing of former Ukranian president’s assets annulled by General Court
In Yanukovych v Council (cases T-302/19 and T-303/19), the General Court has annulled a decision of the Council of the EU extending EU sanctions against Ukraine’s former president and his son.
The General Court annulled the decision on the basis that the Council did not verify that Ukranian judicial authorities carrying out an investigation into the the persons concerned complied with the applicant’s rights of defence, and that there was effective judicial protection in the criminal proceedings at issue, on which the Council’s decision relied.
