Court of Justice grants interim measures against Poland ordering it to stop lignite extraction activities in the Turów mine

By order of the Vice-President delivered today, the Court of Justice (C-121/21 R) has granted the interim measures requested by the Czech Republic in the inter-State case it has brought under Article 259 TFEU against Poland to immediately cease lignite extraction activities in the Turów mine near the borders between Poland, the Czech Republic and Germany.

The Polish authorities granted a concession for the mine to be operated until 30 April 2020, that having been extended under a law that did not require an environmental impact assessment under certain conditions. The Czech Republic considered that Poland had infringed EU law by granting permission for the concession to be extended, which was followed up by the European Commission
