Court of Justice: Professional Qualifications Directive does not prevent Member States from granting partial access to certain healthcare professions

The Court of Justice has just handed down its judgment in Les Chirurgiens-Dentistes de France and Others (C-940/19), a preliminary ruling requested by the French Council of State (Conseil d’État), clarifying that Member States may authorise only partial access to (instead of automatic recognition of) certain healthcare professions under Directive 2005/36 on the recognition of professional qualifications.

The case stems from a dispute between several professional organisations in the healthcare sector and French authorities relating to the French regulatory measures that provide for the possibility of partial access to all healthcare professions, including professions to which the mechanism for the automatic recognition of professi
