Court of Justice rules that Temporary Agency Work Directive applies to EU institutions
The Court of Justice ruled today in Manpower Lit (C-948/19) that Directive 2008/104/EC on temporary agency work applies to EU institutions to which the temporary employees were assigned and therefore prohibits discriminatory treatment in terms of wages.
In the case at hand, UAB “Manpower” Lit assigned temporary workers to the European Institute for Gender Equality (EIGE), an institution of the EU. The workers brought a claim against Manpower before the Lithuanian courts arguing pay discrimination as the wages they were paid by the EIGE (700 euros per month) were lower than those that they would have received had they been recruited directly by the EIGE (2,000 euros per month).
