Court of Justice to hear case on limitation of private hire vehicle licences

In Prestige and Limousine (C-50/21), the Court of Justice will hear a case on the compatibility of EU law with an administrative regulation of the Barcelona Metropolitan Area that sets out several limitations to private hire vehicle (PHV) licences.

The administrative regulation at issue, which the applicants argue is also contrary to Spanish law, provides for a limit of one PHV licence per taxi licence. It also creates a ‘dual licensing’ system which, in addition to the PHV licence (governed by national law and administered by regional authorities) requires a metropolitan licence imposing additional requirements on top of those already existing for PHV licences.
