Court of Justice to rule on whether civil identity of users data is subject to prior review requirement and compatible with EU law

In La Quadrature du Net e.a. (C-470/21), the Court of Justice will hear a request for a preliminary ruling by the French Council of State (Conseil d’État) on whether the civil identity of users data corresponding to an IP address included among the traffic and location data is subject to a prior review requirement, and on the compatibility with EU law of the collection of those data.

The request comes in the aftermath of the referring court’s ruling French Data Networks et autres case, in which it held, in response to the Court of Justice’s preliminary ruling in La Quadrature du Net e.a (C-511/18, C-512/18 and C-520/18), that the EU data protection legal framework and the Court of Justice’s case law allow for the general retention
