COVID-19 and the fundamental rights of refugees, asylum applicants and migrants at the European borders

The EU’s Fundamental Rights Agency has published a report today on the fundamental rights of refugees, asylum applicants, and migrants at the European borders, which recalls that ‘while exercising border control, states have a duty to protect the fundamental rights of all people under their  jurisdiction, regardless of their nationality and/or legal status.

The report includes a section on ‘special measures in case of pandemic’.

In that section, the FRA acknowledges the right of States to manage their borders in a way that includes managing risks to public health in the case of a pandemic.
