Draft mandate for negotiations with UK on Gibraltar adopted by Commission
The European Commission has adopted today a Recommendation for a Council decision authorising the opening of negotiations for an EU-UK agreement on Gibraltar, which comes along with its proposal for negotiating guidelines.
Article 774(3) of the UK-EU Trade and Cooperation Agreement expressly excluded Gibraltar from its territorial scope. This means that the EU must sign with the UK a separate agreement covering Gibraltar concerning trade and other aspects between the British Overseas Territory and the EU, which will be mostly channelled through Spain. This leaves the door open for Gibraltar to fall under the scope of EU rules and programmes, such as Schengen.
