EBA publishes final Guidelines on the monitoring of the threshold for establishing an intermediate EU parent undertaking

The European Banking Authority (EBA) has published its final guidelines on the monitoring of the threshold and other procedural aspects on the establishment of intermediate EU parent undertakings (IPU) as laid down in the Capital Requirements Directive.

This follows a public consultation that was held between January and March 2021 on the draft Guidelines, which provided the EBA with feedback from stakeholders leading to amendments being introduced to clarify some specific provisions.

In accordance with Article 21b of the Directive, institutions belonging to third-country groups with a total value of assets in the EU of the group equal to or greater than 40 billion euros must establish an IPU. In order to take into account
