ECtHR: Politicians have to take the flak
In Savenko (Limonov) v. Russia (Application no. 29088/08), the European Court of Human Rights unanimously held that defamation proceedings by the former mayor of Moscow against the applicant were a violation of the freedom of expression (Article 10 ECHR). The ECtHR points out that the domestic courts should have taken into account the fact that the applicant’s comments were made in the course of a debate on matters of public interest, and that politicians had to be subject to a high level of criticism. The ECtHR also found that the defamation award was excessively high.
