EU initiates WTO dispute against discriminatory procurement by Russian State-owned enterprises

The European Commission has requested consultations with the Russian Federation in the World Trade Organization (WTO), the first step before initiating formal litigation proceedings before the Geneva-based body.

According to the Commission, the dispute concerns Russian measures that restrict or prevent EU companies from selling goods and services to Russian State-owned enterprises and other entities through commercial procurement. There are essentially three measures  which the Commission claims are contrary to WTO law:

(i) discriminatory assessments of procurement bids that allow certain State-related entities to deduct between 15% and 30% off the offered price for certain products or services of Russian entities; (ii) arbit
