EUIPO publishes CP12 Common Communication on evidence in trademark appeal proceedings

The European Union Intellectual Property Office (EUIPO) has published a Common Communication (CP12) in which it provides recommendations in relation to evidence in trademark appeal proceedings, in particular with regard to the filing, structure, and presentation of evidence and the treatment of confidential information.

According to EUIPO, CP12 is the first convergence initiative in the area of trademark appeal proceedings, although its potential applicability may go beyond appeal proceedings and be used in wider contexts including, but not limited to, first instance trade mark proceedings.

CP12 does not deal with the assessment of the probative value of evidence, language-related issues, trademark infringement proceedings
