European Data Protection Board’s dispute resolution decision concerning national supervisory authorities over WhatsApp privacy case

The Irish supervisory authority is the lead supervisory authority (under Article 60 GDPR) to deal with and investigate cross-border privacy matters raised about WhatsApp Ireland Ltd and issue a draft decision.

Under the GDPR, supervisory authorities are under an obligation to cooperate closely with each other, and the lead authority must organise, and present its draft decision for consensus with other authorities.

The Irish supervisory authority submitted its draft decision in December 2020 on whether WhatsApp Ireland complied with its transparency obligations pursuant to Articles 12, 13 and 14 GDPR.

Objections to the draft decision were raised by a number of concerned supervisory authorities of other Member States
