General Court to hear action for damages against Frontex for fundamental rights violation

In WS and Others v Frontex (T-600/21), the General Court will hear an action for damages against the European Border and Coast Guard Agency (Frontex), pursuant to Articles 268 and 340 TFEU, for alleged breaches of fundamental rights under the Charter and of its Code of Conduct and Standard Operating Procedures.

The applicants seek compensation for material damages amounting to more than 95,000 euros, in addition to 40,000 euros for non-material damages. The claim is connected to a return operation that allegedly resulted in the breach of fundamental rights. 

Frontex has been recently subject to media reports citing violations of fundamental rights by deployed officers, who allegedly pushed back potential asylum seekers off
