General Court to hear case on compensation for EU liability with regard to police and justice in Kosovo

The General Court will hear a case (T-771/20, KS and KD v Council and Others) on the EU’s liability arising from its human rights obligations concerning its full operational control under its rule of law mission in Kosovo. Under EU Council Joint Action 2008/124, the European Union Rule of Law Mission in Kosovo (EULEX) was conferred an executive mandate to ensure that war crimes, inter-ethnic crimes and other serious crimes were ‘properly investigated, prosecuted, adjudicated and enforced.

In the case at hand, the applicants seek compensation from the Council of the EU for the damage they claim to have suffered as a result of the alleged violation of several fundamental human rights, specifically under Articles 2 (procedural limb),
