General Court to rule on the scope of Commission’s powers in competition investigation procedures

The Official Journal has recently published the application for legal proceedings before the General Court brought by metal packaging companies Silgan International Holdings BV and Silgan Closures GmbH against the European Commission (T-808/19).

The context of the case is an unannounced investigation and investigation procedure for suspected anti-competitive behaviour.

The Commission issued Decision C(2019) 8501 final of 20 November 2019, through which certain information was requested further to Article 18(3) of the Antitrust Regulation 1/2003.

The applicants sought annulment of that Decision in an action based on five pleas in law.
