General Court upholds Ryanair’s actions for annulment of Commission State aid decisions in respect of TAP and KLM, but dismisses action concerning Spain
The General Court has delivered three judgments concerning actions for annulment brought by Ryanair against the European Commission’s decisions to approve State aid schemes for the airline sector during the COVID-19 pandemic. The cases are:T-465/20, Ryanair v Commission (TAP; COVID-19); T-628/20, Ryanair v Commission (Spain; COVID-19); T-643/20, Ryanair v Commission (KLM; COVID-19).
The General Court has annulled the Commission’s decisions in respect of TAP and KLM on the grounds of inadequate reasoning. On the contrary, it upheld the Commission’s decision in respect of the Spanish recapitalisation scheme for strategic companies, which was also challenged, inter alia, for an infringement of the obligation to state reasons.
