Insight: “‘Co-regulation’ – Commission gets creative with regulatory compromise to tackle Disinformation” by Anjum Shabbir

Online platforms, social media platforms, and advertisers, especially those that are signatories of the Code of Practice on Disinformation, are taking note of Guidance that the European Commission published this week, which addresses criticism of the Code’s current self-regulatory nature (so far allowing industry to avoid legislative obligations in this area). The Guidance is a nudge towards an ad hoc form of ‘co-regulation’ (see Vice-President and Commissioner Jourová’s early remarks on the need for the regulatory shift here), because it suggests tying it with legally binding instruments (either not yet proposed or in force) that set out far-reaching rules for online platforms and advertisers to follow.
