International transfers of data from EU to Korea: process for adequacy decision underway

The European Commission has announced that the process for adopting an adequacy decision under Article 45(3) of the General Data Protection Regulation that would authorise private and public-international transfers of data from the EU to Korea has commenced today.

This comes pursuant to an assessment by the Commission of Korea's law and practices on personal data protection (the Personal Information Protection Act (PIPA)), including the rules on access to data by public authorities, the conclusion of which is that Korea ensures an essentially equivalent level of protection to that guaranteed under the General Data Protection Regulation.
