Bakery sector merger
The merger approval decision of the Commission that we reported on in our post of 23 January was published in the Official Journal yesterday.
It concerns a newly created joint venture between Chinese AB Mauri Yihai Kerry China Investment Holding Company Limited by UK company Associated British Foods and Singaporean Wilmar International Limited, which will operate in the sector of manufacturing, sales and distribution of yeast, bakery ingredients and bakery fats in China.
The decision that there were no competition concerns raised by the joint venture was based on the lack of assets or activities in the EEA, under Article 6(1)(b) of the Merger Regulation.

Another merger approval decision of the Commission, that we posted about in our post of 24 January was also published in the Official Journal yesterday.
That decision concerns the acquisition of German Aquila Capital Holding GmbH (asset and investment manager) by the Japanese Daiwa Securities Group Inc. (financial services company) and German Aquila Holding GmbH (privately-owned holding company).
It was the Commission’s view, further to under Article 6(1)(b) of the Merger Regulation, that limited horizontal overlaps and vertical links between the activities of the companies meant that no competition concerns emerged.
