Op-Ed: “AG Tanchev’s Opinions on the effectiveness principle in EU consumer protection law” by Francisco Pertíñez

On 15 July 2021, Advocate General (AG) Tanchev delivered his Opinions in the cases Unicaja Banco (C-869/19), SPV Project 1503 and Banco di Desio e della Brianza and Others (joined cases C-693/19 and C-831/19), Impuls Leasing România (C-725/19), and Ibercaja Banco (C-600/19). As previously reported on EU Law Live (here), all of these cases concern certain limits that the effectiveness principle imposes on national procedural systems in the field of consumer protection against the use of unfair terms, in accordance with Articles 6(1) and 7(1) of Unfair Terms Directive 93/13.
