Op-Ed: “The European Court of Human Rights renders an Advisory Opinion requested by the Armenian Constitutional Court” by Victor Ferreres Comella
The European Court of Human Rights (ECtHR) has recently issued an Advisory Opinion on an interesting set of issues raised by the Armenian Constitutional Court. (See Advisory Opinion of 29 May 2020, Request no. P16-2019-001.) This is the second time the ECtHR has ever been asked to deliver this type of opinion under Protocol No. 16 to the European Convention on Human Rights.
The context of the case is highly political. A presidential election was held in Armenia on 19 February 2008. The main contenders were Serzh Sargsyan, who was then the Prime Minister, and Levon Ter-Petrosyan, the main opposition candidate.
