Preliminary reference request on the freedoms of establishment and capital

Official publication has been made of a request for a preliminary ruling (C-342/20) from the Helsinki Administrative Court, Finland (Helsingin hallinto-oikeus) on the meaning of the freedoms of establishment under Article 49 TFEU and of capital under Articles 63 and 65 TFEU.

The request stems from a dispute between ‘A’, an investment fund constituted under French law in the form of an open-ended real estate investment fund, which invests in real estate located in France or in the euro area, and the Finnish Tax Authority. ‘A’ has head offices in Paris and branches elsewhere in central Europe.
