Request for a preliminary ruling on appointment of Polish Supreme Court judges published

Official publication has been made of the request for a preliminary ruling lodged by the Poznan District Court (Sąd Rejonowy Poznań-Stare Miasto w Poznaniu) in Rzecznik Praw Obywatelskich (C-521/21), concerning the interpretation of Articles 2, 6 and 19(1) TEU and 47 of the Charter.

The referring court enquires about the compatibility with EU law of the appointment procedure of Supreme Court judges in Poland. It specifically asks whether a court may not be considered a tribunal established by law under the Court’s case-law where its composition includes a person who was appointed following a procedure in which the President appoints a candidate selected by the current National Council of the Judiciary.
