Suez v Commission merger case: action now published

On 25 February 2021, an action was brought before the General Court against the European Commission by Suez, a sustainable environment group based in Paris, and which has now been published (T-121/21).

Suez challenges Commission Decision C(2020) 8969 final, which refuses its request for a declaration that Veolia Environnement S.A. infringed the EU Merger Regulation by acquiring a 29.9% stake in Suez’s capital without the Commission’s prior consent, and which also refused interim measures against Veolia.

It requests annulment of the Decision, alleging first that there was a failure to state reasons as required under Article 296 TFEU, as it is not possible to understand why the Commission considers the derogation under Articl
