The benefit of EU’s protected designation of origin rules extends to signs used for services as well as products, Court of Justice rules

Comité Interprofessionnel du Vin de Champagne (C-783/19), has been decided by the Court of Justice, which has ruled that agricultural products can benefit from protected designation of origin-rules under Article 103(b) of Regulation 1308/2013 in respect of products as well as services.

The dispute in the main proceedings, concerning which this request for an interpretation of the Relegation was requested, was lodged by an organisation defending the rights of champagne producers which did not agree with the use by GB, the owner of tapas bars in Spain of the sign CHAMPANILLO and an image of an image of two champagne coupes containing a sparkling beverage in his trading activities to designate his business premises.
