Action against Commission for not granting access to documents before General Court published

An action for damages against the European Commission over its unlawful conduct in the non-disclosure of certain documents is currently pending before the General Court (Basaglia v Commission, T-257/21), and has now been published.

The applicant seeks damages of more than five million euros in damages for non-contractual liability. 

The unlawful conduct stems from non-compliance with a judgment from the General Court in prior proceedings between both parties (case T-727/19), by which that Court annulled a Commission Decision rejecting the applicant’s request for access to documents.
