Action lodged against Commission for denying access to final report of an OLAF investigation

An action for annulment (Vendrame v Commission, T-379/21) of a decision of the European Commission rejecting a request for access to a final report of an investigation of the European Anti-Fraud Office (OLAF) has been officially published.

The applicant had requested the Commission to provide access to the final report and its annexes after the conclusion of OLAF’s investigation (OC/2019/0766). In the contested decision, the Commission confirmed its previous refusal and denied access to the report. 

The General Court recently ruled in Homoki v Commission that OLAF cannot refuse access to documents where an investigation has been closed and will no longer be prejudiced by disclosure.
