French environmental federation challenges Commission’s refusal to review Delegated Regulation setting out technical criteria for sustainable activity 

The General Court will hear an action for annulment against the Commission’s decision refusing the internal review of Commission Delegated Regulation 2021/2139 that establishes conditions under which an economic activity qualifies as contributing substantially to climate change mitigation and causes no harm to environmental objectives: case Fédération environnement durable and Others v Commission (T-583/22).

The applicant in the case is Fédération environnement durable, a French association created in 2007 opposing wind energy development in France. In its action for annulment before the General Court, the applicant alleges that:
