Op-Ed: “Some News on the Legality of Spatial Restrictions on Gambling: Anesar-CV (C 718/23 to C 721/23 and C 60/24)”

The judgment in Anesar-CV (C-718/23 to C-721/23 and C-60/24), handed down on 16 October 2025, contributes to the body of case law concerning the provision of cross-border gambling services in the EU. It does not raise any novel and complex questions of EU law and was therefore rendered without the Opinion of an Advocate General. The Court upheld the legality of several measures designed to reduce gambling opportunities and to address related addictive behaviours, the objective of which was to decrease the spatial concentration of gambling activities (see also Bonver Win, C-311/19, and Anomar, C-6/01).
