Op-Ed: “The Court Clears France’s ‘Anti-Amazon’ Book Delivery Charge: Reflections on Amazon v. Ministre de la Culture (C-366/24) And Some Long-Standing Internal Market Law Questions”

The judgment in Amazon v. Ministre de la Culture (C-366/24) contains noteworthy developments on several issues concerning the application of internal market freedoms to the delivery of goods. These situations are often complex, as they involve the purchase of goods either online or in physical stores, followed by subsequent delivery, thereby combining elements relating to the free movement of goods and the free movement of services (see, for example, Ker-Optika (C-108/09); Apothekerkammer Nordrhein (C-517/23, on which see also my analysis); Deutsche Parkinson (C‑148/15). The judgment also offers an opportunity to reflect on long-standing questions regarding the scope and application of the TFEU free movement provisions.
