PSPP: Commission closes infringement proceedings against Germany following formal commitments to respect EU law primacy and CJEU jurisdiction

The European Commission has closed its infringement proceedings against Germany over its Constitutional Court’s Weiss judgment of 5 May 2020, by which it declared for the first time a judgment of the Court of Justice ultra vires and not applicable in Germany.

The decision to close the proceedings comes after Germany provided ‘very strong commitments’ in its reply to the letter of formal notice. In the said letter, according to the Commission, the German Federal Government noted that:

It affirms and recognises the principles of autonomy, primacy, effectiveness and uniform application of Union law as well as the values laid down in Article 2 TEU, including in particular the rule of law; It recognises the authority of the Court
